2020 USA Pickleball Instagram Sweepstakes
Starts: July 27th, 2020 and runs through August 21st, 2020

- Terms and Conditions
These Rules govern the USA Pickleball Instagram Sweepstakes (“Official Rules”). Entrants agree to abide by these Official Rules and by the decisions of USA Pickleball, whose decisions are final. Failure to comply with these Rules may result in disqualification from any USA Pickleball Sweepstakes. USA Pickleball reserves the right to permanently disqualify from any of its Sweepstakes any person USA Pickleball believes has violated these Official Rules. USA Pickleball reserves the right to modify or amend these Official Rules, as it deems necessary, with or without notice, at any time and for any reason. - Eligibility Requirements
Entrants must be 18 years of age as of the date of entry in order to enter this Sweepstakes and receive the prizes. The Sweepstakes is open to eligible residents of the U.S.
USA Pickleball employees, contractors, and their immediate families are not eligible.

- How to Enter:
NO PURCHASE OR DONATION IS NECESSARY TO ENTER THIS DRAWING AND RECEIVE THE PRIZES.
To enter this Sweepstakes, each entrant will simply submit a photo via their Instagram channel using the hashtag #USAPickleball and tagging @USAPickleball in the post. Users must also be following @USAPickleball on Instagram and have a public profile in order to be considered. The photo submitted must be original, be pickleball-related, and suitable for publication on our social media channels. Entries that are incomplete or do not adhere to the Rules may be disqualified at the sole discretion of USA Pickleball.
- Limit of one entry. Individuals may submit only one entry during this Sweepstakes.
- Deadlines, Decisions, Notifications and Acceptance
- a. Deadlines (Promotion Period)
Time Period: The Sweepstakes start on Monday, July 27, 2020 at 9 a.m. ET / 6 a.m. PT and concludes on Thursday, August 20, 2020 at 11:59 p.m. ET.
- b. Selection of winners
5 winners will be randomly selected each week starting the week of July 27, 2020. The winning submissions will be randomly selected by a member of the Marketing Team of USA Pickleball using the services of Random.com. - c. Notification and Acceptance of Prizes
The winners will be notified by means of Instagram Direct Message within five days following selection of winners. Winners must follow the @USAPickleball Instagram account. Five winners will be announced each Friday during the Sweepstakes promotion period, starting on July 31, 2020. The last group of winners will be announced on Friday, August 21. The five winners for each week will be announced using a multi-photo frame posted to the USA Pickleball page/or social channels in a collage format, or individual photo frame.
The prizes are non-refundable, non-transferable and not redeemable for cash. The winners are responsible for all taxes and fees applicable to the acceptance and use of their prizes. USA Pickleball will have no liability for winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information. If winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited, and an alternate winner selected. Receipt by winner of the prize offered in this campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations.
- Prizes.
The winners of the campaign will receive an individual item of new USA Pickleball merchandise. The cost of shipping will be paid by USA Pickleball. The retail value of each individual item is approximately $20. Actual/appraised value may differ at time of prize award. The specifics of the prize will be solely determined by USA Pickleball. No cash or other prize substitution will be permitted except at USA Pickleball’s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, will be the sole responsibility of winner(s). No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winner(s) is permitted. Acceptance of the prize constitutes permission for USA Pickleball to use each winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law.
- Winners’ Warranties.
All submissions to the Sweepstakes will be available to USA Pickleball and its affiliates. To ensure that the entries are safe and freely usable, all entrants warrant that:
- They own or otherwise have all rights necessary to provide the contribution, assign their rights as described in these Rules, and do not disclose any information to USA Pickleball that would constitute a violation of confidentiality owed to a third party;
- Their contributions are not a derivative work of a customer-owned deliverable from a project on which USA Pickleball is engaged. If it is a derivative work of a deliverable (customer owned or not) made on such a project, entrants are required to mention it with the details of the project and the name of the customer when submitting their contribution;
- Their contributions do not contain any viruses, worms, spy ware, or other components or instructions that are malicious, deceptive, or designed to limit or harm the functionality of a computer; and
- Their contributions are not subject to license terms that require any software or documentation incorporating or being derived from their contributions to be licensed to others.
- Winners’ Consents and Responsibilities
Winners agree to release USA Pickleball and its respective agents, affiliates, employees, partners, suppliers, and advertising, promotional or judging agencies, from any and all liability whatsoever for injuries, damages, or losses to persons and property that may be sustained in connection with the receipt, ownership or use of the prizes or while preparing for participation in and/or traveling to any prize-related activity. Winners may be required to sign an affidavit/disclaimer and tax forms. Winners will be notified when the appropriate forms need to be signed. Winner consents to the use of his or her name, photograph and/or likeness for advertising and publicity purposes without notice or compensation, unless prohibited by law. The prizes are subject to all applicable laws and regulations. Winners are responsible for all taxes applicable to the acceptance and use of his/her prize. - Disputes
Each entrant and other participant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with the Promotion will be resolved individually, without resort to any form of class action, and exclusively by the federal or Arizona state courts of record in Maricopa County, Arizona; (b) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event will such costs include attorneys’ fees; and (c) under no circumstances will an entrant or other participant be permitted to obtain awards for, and, by entering the Promotion, each entrant and other participant waives all rights to claim, punitive, indirect, special, incidental and consequential damages and any other damages (other than for actual out-of-pocket expenses described in subsection (b), above) and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the entrant and any other participant and USA Pickleball in connection with the Promotion, will be governed by, and construed in accordance with, the laws of the state of Arizona, without giving effect to any choice of law or conflict of law rules (whether of the State of Arizona or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Arizona. All Arizona state and local laws and regulations apply.
- Limitations
VOID IN RHODE ISLAND AND ANY OTHER JURISDICTION WHERE PARTICIPATION IS PROHIBITED. USA PICKLEBALL RESERVES THE RIGHT TO DISQUALIFY AN ENTRANT THAT IT BELIEVES HAS VIOLATED THE LAWS OF THE JURISDICTION IN WHICH THE ENTRANT RESIDES OR THE SWEEPSTAKES WAS HELD. - Additional Conditions and Waivers
USA Pickleball will not be responsible for any system failure (“Failure”), including without limitation, acts of God; telephone, network, electronic, computer failures of any kind; delays in computer transmission; and lost, late, or ineligible submissions. In the event of any Failure, USA Pickleball reserves the right to cancel the Sweepstakes, with or without notice, and/or disqualify an entrant from the event or drawing. Also, in the event of any Failure, USA Pickleball reserves the right to run the Sweepstakes among the entries received prior to the occurrence of the Failure, but will not be required to do so.
THE PRIZES ARE PROVIDED ON AN “AS IS” BASIS. USA PICKLEBALL MAKES NO WARRANTIES, EITHER EXPRESSED OR IMPLIED, WITH RESPECT TO THE PRIZES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL USA PICKLEBALL, ITS SPONSORS OR SUPPLIERS OF THE PRIZES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ASSOCIATED WITH OR ARISING OUT OF THE SWEEPSTAKES.
By entering the Sweepstakes, entrants release and hold harmless USA Pickleball, its respective parent companies, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with the Sweepstakes or the prizes. USA Pickleball reserves the right to prosecute to the fullest extent of the law any individual who attempts to forge any entry or attempts to in any way defraud USA Pickleball.
- Winners list.
To obtain a copy of the winner(s) name(s) or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to USA PICKLEBALL, P.O. Box 7354, Surprise, AZ 85374. Requests must be received no later than August 31, 2020.
